Introduction

The Adjudication Forum is a representative association formed under the Associations Incorporation Act, 1984 (NSW, Australia). It is open to all persons (whether individual or corporate) who have an interest in the various security of payment Acts in Australia and the adjudication process: adjudicators, adjudication submission consultants, lawyers, industry bodies, contractors, subcontractors, suppliers, claimants, and respondents.

Objective

The objective of the Adjudication Forum is to promote adjudication as a means of resolving disputes by:

  1. providing a forum for discussion;
  2. conferences;
  3. publications;
  4. encouraging research;
  5. accepting donations;
  6. making suggestions for legislation.

Basic Operation of Security of Payment Legislation in Australia

If you have stumbled onto this website and know nothing about the operation of the security of payment legislation, the following should assist you.

  1. If you have carried out construction work you are a claimant.
  2. The person that you have done the work for is the respondent.
  3. To get paid the claimant submits a payment claim on the respondent.
  4. The respondent then has (normally) 10 business days to respond to the payment claim with a payment schedule.
  5. The payment claim and the payment schedule forms the basis of the claimant’s entitlement that is determined by adjudication under security of payment.
